A practical understanding of property

Clarity where documents, buildings and value meet

Property disputes often turn on a combination of records and physical facts: what is owned, what was agreed, what was built, how an area was measured and how a monetary claim was calculated.

Our practice combines property valuation, architecture, redevelopment, land acquisition and development feasibility. This background helps us examine technical evidence and explain the commercial effect of disputed assumptions.

Each instruction is defined by its purpose, valuation date, required evidence, independence requirements and the directions of the advocate, court, tribunal or arbitrator.

Areas of work

Independent property evidence for a defined dispute

The report or technical opinion is tailored to the question being considered. It does not decide legal rights or the outcome of a proceeding.

01 / VALUE

Land & building value

Current or retrospective value, competing valuation approaches, development potential and the assumptions behind a property-related monetary claim.

02 / RENT

Rent, occupation & compensation

Market rent, standard-rent or occupation-related value questions, with the relevant date, tenure, use, area basis and evidence stated clearly.

03 / CONSTRUCTION

Construction & redevelopment

Work measurement, agreed carpet area, quantities, specifications, variations, project costs, delivery obligations and documented financial claims.

04 / OWNERSHIP

Family, co-owner & development disputes

Independent value references for partition, buyout or settlement discussions, and value analysis for landowner, developer or joint-development matters.

The role matters

Valuation expert and arbitrator are different roles

Independent valuation or technical expert

A party, advocate, arbitrator, tribunal or court may require a reasoned opinion on land, buildings, rent, construction cost or development feasibility.

The report identifies the material reviewed and explains the evidence, method, assumptions and limitations. It can support a proceeding, but it does not determine the dispute.

Proposed appointment as arbitrator

An arbitrator considers the parties’ submissions and evidence and determines only the issues within the reference. An appointment may arise under an agreement, party process or court order.

An enquiry is not an appointment. Acceptance is subject to the applicable legal process, disclosures, conflict checks, independence, availability and confirmation of the mandate.

No acceptance or outcome is guaranteed. A Sanghvi Valuers report is an independent professional opinion, not legal advice. The court, tribunal, arbitrator or appointing authority decides admissibility, procedure, evidentiary weight and the outcome of the matter.

From enquiry to opinion

A clear, purpose-led process

The first discussion identifies the role required, the valuation question and the relevant date. Documents and inspection requirements can then be defined without collecting unnecessary case material.

  1. Identify the role and partiesState whether you need a valuation expert, technical opinion or proposed arbitrator, and provide the parties’ names for a conflict check.
  2. Define the questionRecord the property, valuation date, issue to be addressed, applicable order or terms of reference and intended use of the work.
  3. Review property evidenceInspect the property where required and examine ownership, area, planning, construction, tenancy, market and financial records relevant to the question.
  4. Provide the defined outputIssue the agreed report or opinion with its method, calculations, assumptions and limitations stated in understandable terms.

Preparing the brief

Documents that help define the matter

Start with a short administrative enquiry. Sensitive documents should be shared only through an agreed channel after the role, conflicts and scope have been reviewed.

  • Court or tribunal order, advocate’s brief, arbitration clause or proposed terms of reference, if available.
  • Names of the parties, representatives and connected entities.
  • A concise chronology and the precise valuation or technical question.
  • Sale deed, Index II, property card, 7/12 extract, lease or other relevant property record.
  • Sanctioned plans, area statements, specifications and measurement records.
  • Contracts, bills, payment schedules and completion records where construction is involved.
  • Existing valuation reports and the calculations or assumptions in dispute.

Common questions

Before making an enquiry

How is a court-appointed arbitrator engaged?

The appointment must follow the applicable court process and order. You or your legal representative can contact the office about availability and the proposed scope. A website enquiry does not itself constitute an appointment.

Can a technical professional act as an arbitrator?

The required qualifications, eligibility and appointment procedure depend on the agreement and applicable law. Architecture and valuation experience can be particularly useful where a dispute involves construction records, area calculations or property value.

Is valuation registration the same as court empanelment?

No. IBBI and CBDT registrations relate to valuation practice. An arbitrator’s appointment and authority arise separately under the applicable agreement, law and appointment terms.

Can Sanghvi Valuers prepare an expert report instead?

Yes. A defined valuation or technical assessment may be commissioned separately, subject to the scope and conflict review. Please state whether the report is sought by a party, a tribunal or a court.

Will a court or arbitrator accept the valuation report?

No professional can guarantee acceptance or a particular outcome. The report sets out an independent opinion, supporting evidence, method, assumptions and limitations. The court, tribunal or arbitrator decides whether it is admitted, what weight it receives and what further evidence is required.

Where can matters be handled?

The practice is based in Pune. Requirements elsewhere in Maharashtra or other locations can be reviewed according to the seat, venue, property location, hearing arrangements and availability.

How are fees and timelines decided?

They depend on the appointment terms, applicable directions or rules, the complexity of the reference and the work involved. The office can confirm availability and the proposed basis after an initial review.
